Terms of Service

These Terms of Service ("Terms") govern your use of the software development and automation services ("Services") provided by Thabani Dev Studio. By engaging Thabani Dev Studio for Services, you agree to these Terms.

1. Services and Proposals

Thabani Dev Studio provides full-stack web development and business automation services. The specific scope, deliverables, timelines, and costs for any project will be detailed in a formal Project Proposal provided to you after an initial discovery process. The Proposal, once accepted, will form part of this agreement.

2. Payments

Payment terms will be specified in the Project Proposal. A standard project requires a non-refundable upfront payment of fifty percent (50%) of the total quoted fee before work commences. The remaining fifty percent (50%) is due upon completion of the project, prior to the final delivery of the work.

3. Client Responsibilities

You agree to provide all necessary information, content (such as text, images, and branding materials), and feedback in a timely manner. Delays in providing these materials may result in adjustments to the project timeline. You are responsible for ensuring you have the legal rights to any content you provide.

4. Intellectual Property

Upon receipt of the final payment, you, the Client, will own the full intellectual property rights to the final, delivered project. Thabani Dev Studio retains the right to display the completed project in its portfolio and marketing materials for promotional purposes.

5. Confidentiality

Thabani Dev Studio will treat all information you share about your business as confidential. This information will not be disclosed to any third party without your prior consent, except as required by law.

6. Limitation of Liability

Thabani Dev Studio will not be liable for any indirect, incidental, or consequential damages, including loss of profits, resulting from the use of its Services. The total liability for any claim arising from this agreement will not exceed the total fees paid by you for the Services.

7. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa.
